User Policy

User Registration Agreement of the AFCA Financial Services Information Platform

Thank you for visiting or using the AFCA Financial Services Information Platform (hereinafter referred to as the "Platform"). The Platform is legally owned and operated by the Asian Financial Cooperation Association.

The User Registration Agreement of the AFCA Financial Services Information Platform (hereinafter referred to as the "Agreement") constitutes an agreement between you and the Asian Financial Cooperation Association (AFCA) regarding your registration, login, and use (collectively referred to as "use") of the Platform. The content of the Agreement includes, but is not limited to, all agreements, rules, specifications, announcements, and in-site notifications related to the services of the Platform that we have already published or may subsequently publish and revise from time to time. Once the aforementioned content is formally published, it becomes an integral part of the Agreement and constitutes an indivisible whole therewith, which shall also be abided by.

To ensure the Platform can better serve you, please carefully read and fully understand the Agreement before you start using the services of the Platform, especially the clauses regarding exemption or limitation of liability, license of rights and use of information, consent to activate and use specific individual services, as well as applicable laws and dispute resolution. Among these, important content such as exemption or limitation of liability clauses will be brought to your attention in bold format, and you should read these sections carefully. Any registered user applying to use the Platform or utilizing the services provided by the Platform shall be deemed to have fully read and understood all the content of the Agreement and agreed to be bound by all the terms herein. If you do not agree to the Agreement, we will be unable to provide you with complete products and services, and you may also choose to cease using them.

Before using the services of the Platform, you must ensure that you have full capacity for civil conduct and are able to agree to and perform the Agreement. Otherwise, please do not use the services. If you agree to these terms on behalf of your employer or other legal entity, you declare that you must have full legal authorization and ensure that your employer or such legal entity agrees to be bound by these terms.

1. Platform Services

1.1 You shall access and use the services of the Platform through [www.afca-fsip.net]. We shall not be liable for any losses you incur if you access the Platform through unauthorized channels.

1.2 To enhance user experience and service quality, we may periodically update or modify the Platform's services (including but not limited to website revisions, upgrades, feature enhancements, and development of new services). Such updates or modifications may be implemented in part or in full directly by us for security purposes or service improvements.

1.3 Unless expressly authorized in writing by us in advance, you are prohibited from engaging in any unauthorized access or use of the Platform's services, including but not limited to adaptation, reproduction, dissemination, vertical search, mirroring, or commercial exploitation.

1.4 We grant you a personal, revocable, non-transferable, non-exclusive, and non-commercial right and license to lawfully use the Platform's services. All rights not expressly granted herein are reserved by us. You must obtain separate written permission from us before exercising any such rights. Our failure to enforce any right or provision shall not constitute a waiver of such right.

1.5 You may begin accessing the Platform's services without registration, but certain features or services may be restricted. Please note that enterprise users, member users, and internal users registered on the Platform may have different access rights. Enterprise Users refer to information platform accounts created for formal staff members of general legal entities holding a Legal Entity Identifier (LEI). Member Users refer to information platform accounts created for formal staff members of AFCA's member institutions. Internal Users refer to information platform accounts created for formal staff members of entities such as the secretariat of AFCA, government departments, and partner organizations. Access to and usage of specific sections of the Platform may vary for enterprise users, member users, and internal users.

1.6 If you find any content on the Platform that infringes your rights, please notify us via afca_news@afca-asia.org and provide evidence substantiating your rights. We will address your complaint promptly in accordance with applicable laws and regulations.

2. Account

2.1 The Platform provides a registration channel, allowing you to legally select a character combination as your account and set a password that meets security requirements. The account and password you set serve as credentials for logging in and accessing Platform services as an enterprise user.

2.2 Account Cancellation

If you need to cancel your account on the Platform, please contact us via afca_news@afca-asia.org. Upon completing reasonable and necessary verification of your identity, security status, and relevant details regarding infringement complaints, we will assist you in closing your account and delete all information pertaining to your account in accordance with your request, unless otherwise specified by laws or regulations.

In particular, please note:

(1) You shall remain liable for your actions during your use of Platform services before canceling the account;

(2) After successful cancellation, account records, functions, etc. will not be restored or provided.

2.3 You understand and undertake that your account shall not violate national laws, regulations, or our policies. Illegal and harmful information shall not appear in your account name, avatar, and other registration information and other personal information. Without the permission of others, you shall not open an account in the name of others (including but not limited to using the name, title, brand name, avatar, or other means that are likely to cause confusion of others), and shall not maliciously register accounts on the Platform (including but not limited to frequent registration, mass registration of accounts, etc.). We reserve the right to review the information you submit. During the process of account registration and use, you need to abide by applicable laws and regulations and shall not engage in any acts that infringe on national interests, damage the legitimate rights and interests of other citizens or organizations, or are harmful to social morality.

2.4 The account you register on the Platform is strictly for use by you and your company/organization. Without our prior written consent, it is prohibited to give, lend, rent, transfer, sell, or otherwise permit others to use the account in any form. If we find or have reasonable grounds to believe that the user is not the initial registrant of the account, we have the right to immediately suspend or terminate the provision of services to the registered account to ensure account security.

2.5 You are responsible for maintaining the security and confidentiality of your account and password, and shall bear full legal liability for all activities conducted under your registered account. This includes, but is not limited to, any legal consequences arising from data modifications, the posting or modification of cases and demands, or other operations performed using the Platform's services. You must highly prioritize the confidentiality of your account and password and must not disclose your account or password to others under any circumstances. Notify us immediately upon detecting that others are using your account without permission or that any other security breach occurs.

2.6 If you need to change your password, you can complete such operations in the [Member Center]. If you forget your password, please contact us at afca_news@afca-asia.org. Member users can also contact us through their designated contact person at the Asian Financial Cooperation Association. After verifying your identity, we will assist you in recovering your account or password. We particularly remind you to properly keep your account and password. After use, you shall log out securely. If your account is stolen or your password is lost due to improper safekeeping on your part or other force majeure factors, you shall bear the corresponding responsibilities on your own.

2.7 When registering, using, and managing the account, you shall ensure the authenticity of the identity information filled in during account registration. Please use authentic, accurate, legal, and valid relevant identification materials and necessary information (including the name of the contact person, contact number, email address, affiliated company, department, position, LEI), etc.) when registering and managing the account. To verify the authenticity and validity of the LEI code provided by corporate users, we will share the institution name, LEI, registration country/region, and other information you provide with the Beijing National Financial Standardization Research Institute. If the materials you submit or the information you provide are inaccurate, untrue, non-compliant, or if we have reason to suspect the information is erroneous, false, or illegal, we have the right to refuse to provide related functions. You may not be able to use the services of the Platform or some functions may be restricted during the use.

2.8 After you complete your account registration, log in to the Platform, and undergo reasonable and necessary identity verification, you can view and modify the avatar information you submitted at any time in your member information.

3. Protection of Personal Information of Users

We are committed to protecting your personal information together with you. Protecting the personal information of users is one of our fundamental principles. During the process of using the services of the Platform, you may need to provide your personal information (including but not limited to your company, department, position, name, contact number, email address, etc.) so that we can provide you with better services and corresponding technical support. We will adopt reasonable technical means and measures to ensure the security of any information collected, preventing loss, misuse, unauthorized access, disclosure, alteration, or destruction. For more details on the protection of user personal information, please refer to the Privacy Policy of the AFCA Financial Services Information Platform.

4. Code of Conduct for Users

4.1 Requirements for User Conduct

You shall be responsible for your actions in using the services of the Platform. Unless permitted by law or with our prior written permission, you shall not engage in the following activities when using the services of the Platform:

4.1.1 Using any plugins, add-ons, systems, or third-party tools that are not authorized or permitted by us to interfere with, disrupt, modify, or otherwise affect the normal operation of the services of the Platform.

4.1.2 Engaging in any activities that harm computer network security by using or targeting the services of the Platform, including but not limited to:

(1) Illegally infiltrating networks, disrupting normal network functions, stealing network data, or other activities that endanger network security;

(2) Providing programs or tools specifically designed for infiltrating networks, disrupting normal network functions and protective measures, stealing network data, or other activities that endanger network security;

(3) Knowingly providing technical support, advertising, promotion, payment settlement, or other assistance to others engaged in activities that endanger network security;

(4) Using unauthorized data or accessing unauthorized servers/accounts;

(5) Accessing to any public network or any third party's network without authorization to delete, modify, or add information in storage;

(6) Attempting to probe, scan, or test the vulnerabilities of the system or network of the Platform, or engaging in other activities that undermine network security;

(7) Attempting to interfere with or damage the normal operation of the system or website of the Platform, deliberately spreading malicious programs or viruses, or engaging in other activities that disrupt normal network information services;

(8) Falsifying the name or part of the name of a TCP/IP packet;

(9) Conducting reverse engineering, reverse assembly, compilation of the services of the Platform, or attempting to discover the source code of the Platform in other ways;

(10) Maliciously registering accounts for the services of the Platform, including but not limited to registering accounts frequently and in batches;

4.1.3 Bypassing any measures we may use to prevent or restrict access to the services.

4.1.4 Impersonating others or organizations, or making false or improper statements about your identity or your relationship with others or organizations.

4.1.5 Using or attempting to use others' accounts, services, or systems without our authorization, or creating a false identity on this platform.

4.1.6 Engaging in other activities that violate laws and regulations, the Agreement, our relevant rules, or infringe upon the legitimate rights and interests of others.

4.1.7 We may make independent judgment and treatment, and have the right to terminate the provision of the Services to you without prior notice and hold you legally responsible for it, provided that we reasonably believe that your acts violate or may violate what is agreed above.

4.2 Information Content Specifications

4.2.1 After you complete the account registration on the Platform as required, you can post or modify financial cases and financial service demands on the Platform with your registered account. The financial cases or financial service demands you post on the Platform will be submitted by us for publication after our review, for users browsing the website to consult.

4.2.2 The information you create, upload, publish, modify, or disseminate shall consciously comply with the "Seven Bottom Lines" requirements, including laws and regulations, the socialist system, national interests, the lawful rights and interests of citizens, public social order, moral customs, and information authenticity. Otherwise, we have the right to take immediate corresponding measures. You agree and undertake not to create, reproduce, publish, or disseminate the following information:

(1) Information opposing the basic principles set forth in the Constitution;

(2) Information endangering national security or leaking state secrets;

(3) Information subverting state power, overthrowing the socialist system, inciting secession, or undermining national unity;

(4) Information harming national honor and interests;

(5) Information promoting terrorism or extremism;

(6) Information inciting ethnic hatred, ethnic discrimination, or undermining ethnic unity;

(7) Information inciting regional discrimination or regional hatred;

(8) Information undermining national religious policies, promoting cults and feudal superstitions;

(9) Information fabricating or spreading rumors or false information, disrupting economic and social order, or undermining social stability;

(10) Information spreading or disseminating obscenity, pornography, gambling, violence, murder, terror, or abetting crime;

(11) Information endangering cybersecurity or using the network to engage in activities harmful to national security, honor, and interests;

(12) Information insulting or defaming others, infringing upon the lawful rights and interests of others;

(13) Information involving violent intimidation, threats against others, or carrying out doxxing;

(14) Information distorting, vilifying, blaspheming, or denying the deeds and spirit of heroes and martyrs, or infringing upon the names, portraits, reputations, or honors of heroes and martyrs by means of insult, slander, or otherwise;

(15) Information spreading vulgar language, damaging social order and good customs;

(16) Information infringing upon the lawful rights of others, such as privacy, reputation, portrait rights, intellectual property rights, etc.;

(17) Information infringing upon the lawful rights and interests of minors or harming their physical and mental health;

(18) Other information that violates laws and regulations, public policies, public order and good customs, interferes with the normal operation of the services of the Platform, or infringes on the legitimate rights and interests of other users or third parties.

4.3 We have established a public complaint and reporting platform. You can report various illegal and non-compliant behaviors, illegal dissemination activities, illegal and harmful information, and other content to us via afca_news@afca-asia.org. We will promptly accept and handle your complaints and reports to jointly create a clean and upright cyberspace.

5. Usage Specifications for Information Content on the Platform

5.1 Without our written permission, no user or third party shall, on their own or authorize, permit, assist any other person to engage in the following actions regarding the information content in the services of the Platform:

(1) Copy, read, or use the information content of the Platform's services for commercial purposes, including but not limited to promotional use;

(2) Edit, organize, or arrange the information content of the Platform's services without authorization and display it on channels other than the source pages of the Platform's services;

(3) Use any form of identification method including but not limited to special identification, special code, etc., and independently or assist a third party to generate adverse effects traffic, reading volume guidance, transfer, hijacking etc. on the information or content of the Platform's services;

(4) Other actions that illegally obtain or use the information content of the Platform's services.

5.2 Without our written permission, no user or third party shall directly or indirectly steal the text, pictures, videos, etc. of the information content of the services of the Platform in any way (including but not limited to hotlinking, redundant stealing, illegal scraping, simulated downloading, deep linking, fake registration, etc.), or delete or alter the electronic information for rights management of the relevant information content in any way (including but not limited to hiding or modifying domain names, Platform-specific identifiers, usernames, etc.).

5.3 After obtaining our written permission, any sharing, forwarding, or other actions by users or third parties regarding the information content of the Platform's services shall also comply with the following standards:

(1) No changes of any form may be made to the source web pages of the Platform's services, nor may any obstructions, insertions, pop-ups, or other hindrances of any form be applied to the display of the source pages of the Platform's services;

(2) Safe, effective, and strict measures must be taken to prevent the information content of the Platform's services from being illegally obtained by third parties through any means, including but not limited to crawlers;

(3) The relevant data content shall not be used for purposes beyond the scope of our written permission, for any form of sale or commercial use, or disclosed, provided to third parties, or permitted to be used by third parties in any way;

(4) Any sharing, forwarding, or copying of the information content of the Platform's services to any third party must comply with other norms and standards established by us for this purpose.

6. Changes, Interruptions, and Terminations of Services

6.1 You understand and agree that the services we provide on the Platform are offered based on the current state achievable by existing technologies and conditions. We will make our best efforts to provide you with services and ensure their continuity and security. You understand that we cannot constantly anticipate and guard against technical and other risks, including, but not limited to, force majeure, network issues, and other reasons that may cause service interruptions, inability to use the Platform and its services normally, and other losses and risks.

6.2 You understand and agree that for the needs of overall service operation and Platform operational security, we have the right, depending on the specific circumstances, to determine service/function settings and scope, and to modify, interrupt, suspend, or terminate part or all of the Platform's services.

7. Intellectual Property Rights

7.1 Except for content for which we have obtained republication authorization, the intellectual property rights of the original content we provide in the Platform's services (including but not limited to technology, web pages, text, images, graphics, audio, video, charts, layout designs, electronic documents, etc.) shall be owned by us. The copyright, patent right and other intellectual property rights of the software on which we rely to provide the services of the Platform shall be owned by us. Without our permission, no one may use (including but not limited to monitoring, copying, disseminating, displaying, mirroring, uploading, downloading through any programs or devices such as crawlers) the content within the Platform's services.

7.2 You understand and undertake that the content uploaded, published, or modified when using the services of the Platform is either original by you or has obtained legal authorization (including sub-authorization). The intellectual property rights of any content you upload and publish through the Platform belong to you or the original copyright owner.

7.3 You confirm and agree to authorize the Asian Financial Cooperation Association to act on your behalf in its own name or authorize a third party to protect the rights of content you uploaded and published for which you own the intellectual property rights or have obtained legal authorization. Methods of rights protection include, but are not limited to: monitoring infringing acts, sending a letter of safeguarding rights, initiating lawsuits or arbitration, mediation, settlement, etc. We have the right to make decisions regarding rights protection matters and implement them independently.

7.4 We own all rights to all data and information generated during the development and operation of the Platform's services, to the extent permitted by laws and regulations.

7.5 Under no circumstances should you privately use any of our trademarks, service marks, trade names, domain names, website names, or other prominent brand features (collectively referred to as "Marks"), including but not limited to the "Asian Financial Cooperation Association" and the Platform. Without our prior written consent, you shall not display, use, apply for trademark registration, register domain names, etc. of the aforesaid identifications in a separate or combined manner, nor shall you carry out any act of explicitly or implicitly indicating to others that you have the right to display, use, or otherwise handle these identifications. The full legal liability of losses caused to us or others as a result of your violation of the Agreement to use our aforementioned trademarks, marks, etc., shall be borne by you.

8. Handling of Breaches

8.1 Regarding your actions that violate the Agreement or other service terms, we have the right to independently judge and, depending on the circumstances, take measures such as issuing a warning, refusing to publish, immediately stopping the transmission of information, deleting content, imposing a short-term ban on publishing content, restricting part or all of the account functions, terminating the provision of services, permanently closing the account, and other measures we deem necessary. For any consequences such as your inability to use the account and related services normally, inability to obtain the assets or other rights within your account normally, we shall not bear any responsibility. We have the right to decide whether to restore the use of the relevant account according to the actual situation. For acts suspected of violating laws, regulations, or being involved in illegal or criminal activities, we will keep relevant records and have the right to report to the relevant competent authorities in accordance with the law, cooperate with investigations by competent authorities, report the case to public security organs, etc. We have the right not to restore the deleted content.

8.2 If your violation of the Agreement or other service terms leads to complaints from third parties or litigation claims, you shall handle the matter yourself and bear all potential legal liabilities arising therefrom. If your illegal, infringing, or breaching actions cause us to compensate any third party or suffer penalties from state authorities, you shall also fully compensate us for all losses we suffer as a result.

8.3 We respect and protect the intellectual property rights, reputation rights, right to name, privacy rights, and other legitimate rights and interests of users and others. You guarantee that the text, images, links, etc., uploaded when using the Platform's services do not infringe upon any third party's intellectual property rights, reputation rights, right to name, privacy rights, and other rights and legitimate interests. Otherwise, we have the right to remove the allegedly infringing content upon notification from the rights holder or relevant party. For all claims made by a third party, you shall handle them on your own and bear all possible legal responsibilities arising therefrom; if your infringing actions cause us to suffer losses (including economic, reputational losses, etc.), you shall also fully compensate us for all losses suffered.

9. Disclaimer

9.1 You acknowledge and agree that the services provided by the Platform may be affected or disrupted by various factors. We cannot provide any explicit or implicit warranties regarding (including but not limited to) the following situations, and your use of the Platform's services shall be at your own risk.

9.1.1 The Platform's services will fully meet uses' requirements;

9.1.2 The services of the Platform are uninterrupted, timely, secure, reliable and error-free; any services or other materials obtained by users through us will meet users' expectations;

9.1.3 Any errors in the services of the Platform will be corrected.

9.2 The purpose of the information displayed on the pages of the Platform is to disseminate more information and has nothing to do with the position of the Asian Financial Cooperation Association. We do not guarantee the accuracy, authenticity, completeness, effectiveness, timeliness, originality, etc. of all or part of the information (including but not limited to text, data, and charts). The relevant information has not been verified by this website and does not constitute any investment advice or business advice to you. Please treat it with caution and make your own judgments. Except as otherwise expressly provided by laws and regulations, we shall not bear any direct, indirect, joint or punitive liability for any losses you may suffer, including loss of profits, damage to business reputation, data loss, or other tangible or intangible losses.

9.3 You understand and agree that during the use of the Platform's services, you may encounter factors such as force majeure (which refers to objective events that cannot be foreseen, overcome, and avoided), including but not limited to natural disasters (floods, earthquakes, typhoons, etc.), government actions, war, strikes, riots, etc. In the event of force majeure, we will strive to restore the services promptly, but we shall be exempt from liability for any suspension, interruption, termination of services, or any losses caused by force majeure to the extent permitted by laws and regulations.

9.4 We have the right to handle illegal and non-compliant content in accordance with laws, regulations, the Agreement, and the platform rules. However, this right does not constitute our obligation or commitment, and we cannot guarantee that illegal acts will be discovered in a timely manner or that corresponding actions will be taken.

9.5 You understand and agree that the Agreement aims to ensure compliance with national laws and regulations, maintain public order and good customs, and protect the legitimate rights and interests of users and others. We will make our best efforts within our capabilities to make judgments in accordance with relevant laws and regulations. However, we do not guarantee that our judgments will be completely consistent with those of judicial or administrative organs. You understand and agree to bear the consequences arising therefrom on your own.

9.6 Except as otherwise expressly provided by laws and regulations, we shall not be liable for any indirect, consequential, punitive, incidental, special, or punitive damages suffered by you due to your use of the Platform's services. The total liability we bear to you shall not exceed the fees you paid to us (if any) during your use of the Platform's services.

10. Special Provisions on Individual Services and Third-Party Services

10.1 The Platform's services include information or information content links obtained by us through various legal means. These services may exist in the form of separate sections on the Platform. We have the right to add, reduce, or modify the setup and services of these special sections from time to time.

10.2 If you use relevant services provided by a third party on the Platform, in addition to complying with the Agreement and other relevant rules of the Platform, you may also need to agree to and comply with the agreements, policies and relevant rules of the third party. Any disputes, losses, or damages arising from third-party software and related services shall be resolved independently between you and the third party. Except as otherwise provided by laws and regulations, we do not assume any responsibility towards you or any third party in this regard.

10.3 The Platform may contain hyperlinks pointing to other websites or resources. We do not guarantee the accuracy, completeness, or timeliness of third-party materials accessible via these hyperlinks and assume no responsibility for them.

11. Terms of Use for Minors

The Platform is not intended for minors under the age of 18. We undertake not to knowingly collect personal information from minors. Minors are requested not to send personal information to the Platform. If we collect information of minors unknowingly, the Platform will delete it as soon as possible after becoming aware of it. If you believe we may improperly hold information from or about a minor, please contact us.

Minor users and their guardians understand and confirm that in case of you violating laws and regulations and the Agreement hereof, you and your guardians shall bear all legal responsibilities that may result from this according to law.

12. Miscellaneous

12.1 The formation, validity, performance, interpretation, and dispute resolution of the Agreement shall be governed by the laws of the People's Republic of China. If any provision of the Agreement is invalid or unenforceable due to conflict with the laws of the People's Republic of China, such provisions shall be interpreted and applied as closely as possible to the original intent of the provisions of the Agreement without violating the law, and the remaining provisions of the Agreement shall remain in full force and effect.

12.2 The Agreement is entered into at Xicheng District, Beijing, People's Republic of China. If any dispute arises between you and us, both parties shall strive to resolve it through friendly negotiation. If negotiation fails, you agree to submit the dispute to the competent people's court in the place of execution of the Agreement for litigation settlement.

12.3 In order to provide you with better services, or due to changes in national laws and regulations, policies, technical conditions, service functions, etc., we will revise the Agreement as appropriate. And the revised content shall form an integral part of the Agreement. After the Agreement is updated, we will release the updated version on the Platform and notify you of the updated content through the official website [www.afca-fsip.net] announcements or other appropriate methods before the updated terms take effect, so that you can timely understand the latest version of the Agreement. You can also check the latest terms of the Agreement on the website page. If you continue to use the Platform's services, it means you have accepted the revised content of the Agreement.

If you have objections to the revised agreement terms, please immediately stop logging in or using the services of the Platform. If you continue to log in or use the services of the Platform, it shall be deemed that you have recognized and accepted the revised agreement terms.

12.4 We have the right to unilaterally decide to arrange or designate a third party recognized by us to continue operating the Platform, in light of the needs of the Platform's services or operations. Moreover, certain services covered under the Agreement may be provided to you by a third party recognized by us. Your knowledge and acceptance of the relevant service content shall be deemed as acceptance that the relevant rights and obligations are also bound by the Agreement.

12.5 The headings in the Agreement are for convenience of reading only and shall not affect the meaning or interpretation of any provision in the Agreement.

12.6 You and we are independent entities. Under no circumstances shall the Agreement constitute any form of express or implied warranty or condition by us to you, nor shall it constitute an agency, partnership, joint venture, or employment relationship between the two parties.

12.7 The final interpretation right of the service terms of this website belongs to the Asian Financial Cooperation Association.
